Massachusetts: FPF testifies regarding Massachusetts Student Data Privacy Bill

On November 20, 2023, the Future of Privacy Forum (FPF) announced that it had provided, on October 30, 2023, a testimony before the Massachusetts Joint Committee on Education regarding an Act Relative to Student and Educator Data Privacy. The FPF testimony focused on various topics to include, among other things:

  • utilizing FPF case studies; 

  • using FPF's privacy law trackers; 

  • using FPF ethics training scenarios; and 

  • recommendations for improving the Bill. 

Importantly, the FPF testimony highlighted expanding the Bill's training requirements beyond educators, as procurement, IT, and other administrative staff often also have access to covered data. Regarding the Bill's introduction of a private right of action, the FPF anticipates continued legislative debate.
