International: Schrems makes statement on Schrems II anniversary, calls for 'no spy' agreement

None of your business ('NOYB') published, on 16 July 2021, a statement by Maximilian Schrems on the anniversary of the Court of Justice of the European Union's ('CJEU') judgment in Data Protection Commissioner v. Facebook Ireland Limited, Maximillian Schrems (C-311/18) ('the Schrems II Case'). In particular, Schrems criticised the response to the Schrems II judgment by various stakeholders, claiming that "relevant stakeholders have mainly engaged in deflection and finger pointing" whilst also alleging inaction on the part of data protection authorities.

In addition, Schrems outlined his belief that the European Commission's new Standard Contractual Clauses are not a long-term solution to the issues highlighted in the Schrems II Case and furthermore cast doubt on the prospect of legislative reform of US surveillance laws. However, Schrems highlighted a 'no spy' agreement among democratic nations that protects users' human right to privacy, independent of location and citizenship, as a possible solution to EU-US data transfers. Further to this point, Schrems noted that NOYB will continue to work on a long-term solution.
