International: CoE issues guidelines on facial recognition
The Council of Europe Consultative Committee of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data ('Convention 108') issued, on 28 January 2021, guidelines on facial recognition. In particular, the guidelines aim at providing a set of measures for governments, facial recognition developers, manufacturers, service providers, and entities using facial recognition technologies to enable the protection of human rights and personal data. More specifically, the guidelines cover, among other things, the lawfulness of facial recognition technologies' use by public and private entities, accountability, the implementation of Data Protection Impact Assessments ('DPIA'), data security, and the safeguarding of data subject rights. In addition, with respect to data security measures to be adopted by developers of facial recognition technology, the guidelines emphasise that such measures should evolve over time, as well as be proportionate to the sensitivity of data.
