Guernsey: ODPA releases guidance on international data transfers
The Office of the Data Protection Authority ('ODPA') released, on 25 November 2022, guidance on transferring personal data outside of the country. In particular, the ODPA highlighted that, by 27 December 2022, all local organisations who rely on the European Commission's Standard Contractual Clauses ('SCCs') to safely transfer people's data outside of the country will have to ensure they are using the updated SCCs published in June 2021.
More specifically, the ODPA explained the scope and goals of SCCs and that, after 27 December 2022, organisations must ensure that all their contracts implement the updated SCCs, as adopted in June 2021, if they relate to how they use and transfer personal data outside of the Bailiwick of Guernsey.
