Guernsey: ODPA issues guidance on data protection and AI systems, outlines key considerations

On May 26, 2023, the Office of the Data Protection Authority (ODPA) published guidance on how data protection law applies to the use of personal data within AI systems. The guidance clarifies what is classified as artificial intelligence (AI) and the key aspects of data protection that must be understood and implemented when using personal data within AI systems. This includes:

  • scope and definitions;
  • lawful processing conditions;
  • data protection principles;
  • individuals' rights;
  • Data protection by Design and by Default;
  • security and data breach notification; and
  • international data transfers.
