France: CNIL publishes statement on law transposing Digital Services Act

On May 24, 2024, the French data protection authority (CNIL) published a statement on Law No. 2024-449 of May 21, 2024, aimed at securing and regulating the digital space (SREN).

In particular, CNIL highlighted that SREN transposes the Data Governance Act (DGA) and the Digital Services Act (DSA), and that in both cases CNIL is the competent authority for ensuring compliance with the provisions of the DGA and DSA. Specifically, regarding the DSA, CNIL outlined its authority to impose corrective measures and fines, noting that such powers are identical to those contained within Act No.78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties (as amended to implement the General Data Protection Regulation).
