Florida: Governor signs bill on AI use in political advertising into law

On April 26, 2024, House Bill 919 for an act relating to artificial intelligence use in political advertising was signed by the Governor of Florida into law. This follows the Act's introduction to the House of Representatives on December 18, 2023.

What are the main provisions of the Act?

The Act provides that if a political advertisement, electioneering communication, or other miscellaneous advertisement of a political nature that contains images, video, audio, graphics, or other digital content created in whole or in part with the use of generative artificial intelligence (AI), that appears to depict a real person performing an action that did not actually occur, and was created with the intent to injure a candidate or to deceive regarding a ballot issue, the advertisement or communication must prominently state the following disclaimer: 'Created in whole or in part with the use of generative artificial intelligence (AI).' The Act also provides specific requirements for the disclaimer depending on whether the piece of content is printed, a television or video communication, an internet public communication, an audio communication, or a graphic communication.

Additionally to any civil penalties provided by law, the Act also states that a person who fails to include the necessary disclaimer commits a misdemeanor of the first degree.

Entry into force

The Act will enter into force on July 1, 2024.
