Finland: Deputy Ombudsman orders Psykoterapiakeskus Vastaamo to notify data subjects of data breach

The Office of the Data Protection Ombudsman ('the Ombudsman') announced, on 23 October 2020, that the Deputy Data Protection Ombudsman ('the Deputy Ombudsman'), had ordered Psykoterapiakeskus Vastaamo to notify data subjects of a data breach without undue delay. In particular, the Deputy Ombudsman noted that notification on the Vastaamon website alone was not a sufficiently effective means of reporting the data breach. In addition, the Deputy Ombudsman highlighted that the notification must clearly describe the breach and its likely consequences for the data subjects, as well as the measures taken or intended to be taken by the controller due to the security breach. Moreover, the Deputy Ombudsman stated that data subjects must be provided with the contact details of the controller for further enquiries. Furthermore, the Ombudsman issued guidance for the victims of the breach.

Ombudsman launches investigation of Psykoterapiakeskus Vastaamo

The Ombudsman announced, on 27 October 2020, that it had launched an investigation into whether the Response Office of Psykoterapiakeskus Vastaamo acted in accordance with data protection law. In addition, the Ombudsman noted that it will examine, in particular, the appropriateness of Vastaamos' preparation of a Data Protection Impact Assessment and the measures taken in accordance with it and that the investigation was being conducted in cooperation with the Central Criminal Police and other authorities.
