EU: LIBE Committee adopts position on proposal for interim data processing regulation on combatting child sexual abuse
The European Parliament announced, on 7 December 2020, that its Civil Liberties, Justice and Home Affairs ('LIBE') Committee had adopted its position on the Europe Commission's Proposal for a Regulation on a Temporary Derogation from Certain Provisions of Directive 2002/58/EC of the European Parliament and of the Council as regards the Use of Technologies by Number Independent Interpersonal Communications Service Providers for the Processing of Personal and Other Data for the Purpose of Combatting Child Sexual Abuse Online. In particular, the Parliament highlighted that the LIBE Committee's position provides, in relation to the use of specific technologies for the purpose of detecting online material linked to child sexual abuse, that the used technologies must be the least intrusive to privacy, as they should not be able to understand the substance of the content, but only detect patterns. In addition, the Parliament noted that the LIBE Committee's position requires the erasure of all data immediately when no online child sexual abuse has been detected, as only in confirmed cases can the strictly relevant data be stored for use by law enforcement for a maximum of three months.
