EU: EDPB publishes updated guidelines on identifying a controller or processor's supervisory authority
The European Data Protection Board ('EDPB') announced, on 17 April 2023, the publication, on the same date, of updated Guidelines 8/2022 on identifying a controller or processor's lead supervisory authority. In particular, the guidelines provide that they were adopted, on 28 March 2023, following a public consultation. More specifically, the guidelines provide that they are an updated version of the Working Party 29 Guidelines on the Lead Supervisory Authority.
Furthermore, the guidelines outline the need for additional clarifications regarding the establishment of joint controllership and taking into account the EDPB Guidelines 7/2020 on the concept of controller and processor in the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'). Therefore, the guidelines provide that the paragraph concerning joint controllership has been revised and updated, while the rest of the guidelines has remained unchanged, except for editorial changes.
