The European Data Protection Board ('EDPB') announced, on 15 December 2021, that following public consultation, the EDPB had adopted a final version of its Guidelines 01/2021 on Examples regarding Data Breach Notification ('the Guidelines'). In particular, the EDPB noted that these guidelines complement the Article 29 Working Party's guidance on data breach notification by introducing more practice orientated guidance and recommendations. In addition, the EDPB highlighted that the Guidelines aim to help data controllers in deciding how to handle data breaches and what factors to consider during risk assessment. Furthermore, the EDPB stated that following public consultation, the Guidelines were updated to reflect comments received.
