EU: DSA enters into effect for large platforms

The European Commission announced, on August 25, 2023, that the Digital Services Act (DSA) entered into force, on the same date, for large online platforms following its general entry into effect on November 16, 2022. The European Commission confirmed that 19 platforms and search engines with at least 45 million users will have to comply with the DSA rules, including data collection, privacy, and disinformation requirements. In relation to data protection, the European Commission highlighted that the DSA introduces two new restrictions concerning targeted advertising: (i) banning targeted advertising of minors based on profiling, and (ii) banning targeted advertising using special categories of personal data, such as sexual orientation or religion. Furthermore, the European Commission noted that it will specify conditions for the sharing of data and the purposes for which the data may be used.
