EU: Commission closes proceedings against TikTok regarding DSA compliance

On August 5, 2024, the European Commission announced that TikTok Technology Limited committed to withdrawing the TikTok Lite Rewards program to comply with the Digital Services Act (DSA). This follows a formal request for information (RFI) sent by the Commission to TikTok in April 2024.

The Commission highlighted that TikTok committed to:

  • withdrawing the TikTok Lite Rewards from the EU permanently; and
  • not launching any other program that would circumvent the withdrawal.

The Commission noted that it is closing the formal proceedings opened against TikTok in April 2024, but that the proceedings launched in February 2024 regarding potential violations of the DSA in relation to systemic risks remains open.

Notably, the Commission provided that the TikTok Lite Rewards program was launched without prior diligent assessment of the risks it entails, regarding the addictive effects of the program, and without taking risk mitigating measures. The Commission detailed that the program may have potentially negative effects on the physical and mental health of users.

Very Large Online Platforms (VLOPs) under the DSA must perform a risk assessment and submit a report to the Commission prior to launching any new functionalities that are likely to have a critical impact on systemic risks. The Commission clarified that TikTok also adopted effective mitigating measures to address identified risks.
