Czech Republic: UOOU publishes cookie compliance activity findings
The Office for Personal Data Protection ('UOOU') published, on 30 June 2022, its findings, following the monitoring activity conducted in the first half of 2022, as part of its control plan, to establish whether website operators complied with the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'). In particular, the findings note the use of non-technical cookies without consent, a disproportionately long period of validity of cookies in relation to their purpose, absence of the choice for expressing objection to the use of non-technical cookies in the first layer of the cookie bar, incorrect classification of cookies, absence of information about specific cookies used, and provision of information about cookies in a foreign language. Lastly, the findings provide that the rules on cookies are found under Sections 89(1) and (3) of the Act No. 127/2005 Coll. of 22 February 2005 on Electronic Communications and on Amendment to Certain Related Acts.
