Czech Republic: Ministry of Justice discusses whistleblowing bill with NGOs and public sector representatives

The Ministry of Justice announced, on 3 September 2020, that it had discussed the whistleblowing bill with non governmental organisations ('NGOs') and public sector representatives. In particular, the Ministry outlined that some of the main reservations of the parties concerned the subordination of the protection of whistleblowers to the Ministry itself. In this regard, the Ministry recalled that it does not agree with these positions, and that it is capable of carrying out the task with competence and independence. However, the Ministry guaranteed, on the basis of a request from NGOs, that it will carry out an impact assessment and a cost calculation of the external notification system. Moreover, the Ministry reminded that the bill complies with the requirements of Directive (EU) 2019/1937 of 23 October 2019 on the Protection of Persons who Report Breaches of Union Law. Lastly, the Ministry noted that the bill will be submitted to the Government of the Czech Republic in September and should consequently enter into force at the latest on 17 December 2021.
