Cyprus: Commissioner issues guidelines on distance learning and assessment during Coronavirus

The Office of the Commissioner for Personal Data Protection ('the Commissioner') issued, on 20 May 2020, guidelines ('the Guidelines') for higher education institutions on distance learning and student assessment in the context of the COVID-19 ('Coronavirus') pandemic. In particular, the Guidelines outline, among other things, that institutions must abstain from the use of application of systems or tools which process personal data through biometric methods, and that where tools are used for the identification of students during the monitoring of the examinations via audio or visual materials, consent must be the legal bases of processing, provided that the conditions under Article 7 of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR') are met, and there is an alternative in case consent cannot be obtained. In addition, the Guidelines highlight that the institutions must strictly adhere to the principles of proportionality and data minimisation, avoid processing sensitive personal data, and be transparent with their processing operations, among others.
