China: CAICT issues Face Information Processing Compliance Operation Guide

The China Academy for Information and Communications Technology ('CAICT') announced, on 26 January 2022, the publication of the Face Information Processing Compliance Operation Guide ('the Guide') on 18 January 2022. In particular, the CAICT highlighted that the Guide was developed with support from law firms, academic institutions, and relevant technological organisations. More specifically, the CAICT outlined that the Guide establishes compliance points and practical cases for the entire life cycle of face information processing, and aims to provide detailed compliance guidelines for the future development of the facial recognition industry.

In addition, the CAICT noted that the Guide proposes the establishment of compliance principles in relation to the processing of facial information, including legality, legitimacy, necessity, and integrity. Further, the CAICT provided that the Guide distinguishes multiple compliance requirements in different scenarios for face information processors when collecting the related personal data. Likewise, the CAICT detailed that the Guide provides that different collection methods have different effects on data subjects' right to be informed.
