China: CAC request public comments on draft Algorithm Management Regulation

The Cybersecurity Administration of China ('CAC') released, on 27 August 2021, the State Internet Information Office's draft Internet Information Service Algorithm Recommendation Management Regulations and is requesting public comments on the same. In particular, the regulation outlines requirements for algorithm recommendation service providers in accordance with the Cybersecurity Law, the Data Security Law, the Personal Information Protection Law, and the Internet Information Service Management Measures. More specifically, the regulation states that algorithm recommendation service providers who provide algorithm recommendation services must abide by laws and regulations, respect social ethics, abide by business and professional ethics, and follow the principles of fairness, openness, transparency, scientific rationality, and honesty.

In addition, the regulation provides algorithm recommendation service providers must implement, among other things, algorithm security, security assessment monitoring, emergency response to security incidents, data security protection, and personal information protection management systems. Furthermore, the regulation stipulates that where algorithmic recommendation service providers provide services to minors, it must fulfil the obligation of protecting minors in accordance with law, and facilitate the development of a model suitable for minors and providing services suitable for minors' characteristics, among other things.
