China: CAC issues Internet Information Service Algorithm Recommendation Management Regulations

The Cyberspace Administration of China ('CAC') issued, on 4 January 2022, the Internet Information Service Algorithm Recommendation Management Regulations. In particular, the Regulations apply to algorithm technologies including those which generate synthesis, personalised push notifications, sorting and selection, retrieval and filtering, and scheduling and decision-making to provide users with information.

In addition, the Regulations provide general requirements of algorithm recommendation service providers, including the strengthening of information security, the establishment and or improvement of a database for identifying illegal and unhealthy information, and the improvement of storage standards for personal information. Furthermore, the Regulations provide for the protection of user rights including, among other things, the provision of options that are not specific to their personal characteristics, the options to turn off algorithm recommendation services, and explain the impact of algorithm recommendation services that have a significant impact on the rights and interests of users. More specifically, the Regulations include provisions for extra protection of minors and the elderly regarding algorithm recommendation services.

Moreover, the CAC noted that the Regulations will come into force on 1 March 2022.
