Chile: Chamber of Deputies approves cybersecurity law, presented for Senate consideration

On December 12, 2023, the Chilean Chamber of Deputies announced that Bulletin No. 14847 for a Bill to Establish Framework Law on Cybersecurity and Critical Information Infrastructure has been approved and has been resent to the Chilean Senate for approval. If approved, the bill would, among other things:  

  • establish an institutional framework and general regulations to structure, regulate, and coordinate State agencies;  
  • establish minimum requirements for the prevention and response to cybersecurity incidents; and 
  • create new State agencies responsible for matters of cybersecurity. 

What agencies are created by the bill? 

Regarding new State agencies, the bill creates the National Cybersecurity Agency (ANCI) which will have regulatory, supervisory, and sanctioning powers regarding computer security. The ANCI will advise the President in matters of cybersecurity. In addition to the ANCI, the bill creates an Interministerial Cybersecurity Committee that will also advise the President, in addition to being responsible for approving the list of essential services and vital operators proposed by the ANCI. 

Lastly, the bill will create the National Defense Computer Security Incident Response Team (CSIRT) which will be responsible for the coordination, protection, and security of networks and systems of essential services and operators vital to national defense. The CSIRT will report to the Minister of Defense.
