Canada: NSIRA reviews CSIS dataset regime

On March 28, 2024, the National Security and Intelligence Review Agency (NSIRA) announced that it conducted a review of the dataset regime introduced by the Government of Canada through the National Security Act 2017 as a modification to the Canadian Security Intelligence Service (CSIS) Act in July 2019.

In particular, the NSIRA stated that the dataset regime, constituting Sections 11.01-11.25 of the CSIS Act, enables the CSIS to collect and retain datasets containing personal information that is not directly and immediately related to activities that constitute a threat to the security of Canada but are likely to assist in national security investigations. More specifically, the NSIRA found that CSIS's current application of the dataset regime is inconsistent with the statutory framework.
