Brazil: President signs order nominating ANPD members
The President of the Federative Republic of Brazil, Jair Bolsonaro, issued, on 15 October 2020, an order by which he nominated five members of the Brazilian data protection authority ('ANPD') as provided by Law No. 13.709 of 14 August 2018, General Personal Data Protection Law (as amended by Law No. 13.853 of 8 July 2019) ('LGPD') and forwarded their names to the Federal Senate for approval. In particular, Bolsonaro nominated Waldemar Gonçalves Ortunho Junior for the position of President Director of the ANPD for a six-year term and Joacil Basilio Rael, Nairane Farias Rabelo Leitão, Miriam Wimmer, and Arthur Pereira Sabbat for the position of Directors for two to five-year terms. Under the LGPD, the ANPD is tasked with among others, ensuring the protection of personal data, developing relevant guidelines, and investigating and enforcing against violations of data protection, as well as promoting cooperation actions with data protection authorities from other countries.
The nominations by Bolsonaro need to be considered and approved by the Senate first, before they take effect.
