Brandenburg: Brandenburg LDA updates guidelines on File Inspection and Information Access Act

The State Commissioner for Data Protection and Access to Information Brandenburg ('Brandenburg LDA') announced, on 11 January 2023, that it had published a revised version of its guidelines on the File Inspection and Information Access Act 1998 ('AIG'). In particular, the Brandenburg LDA explained that the practical implementation of the provisions of the AIG still poses difficulties, specifically in relation to its scope of application, the processing of personal data, and the handling of business and trade secrets, among others.

As such, the Brandenburg LDA noted that the revised guidelines aim to make it easier for public bodies to comply with the AIG and to help applicants assess the prospects of success of their freedom of information requests.
