Botswana: Transitional period to comply with Data Protection Act extended

OneTrust DataGuidance confirmed on February 1, 2024 with Obakeng Lebotse, Partner at Bookbinder Business Law, that on October 13, 2023, the Ministry of State published an order extending the grace period for the Data Protection Act 2018 (the Act) to October 13, 2024, upon the issuance of the Data Protection (Amendment) Act (Transitional Period) Order, 2023 (the Order).

In particular, the Order provides that persons required to comply with provisions of the Act with regard to the processing of personal data under Section 54 of the Act shall, within a period of 12 months, with effect from October 13, 2023, comply with the provisions of the Act.
