Bosnia & Herzegovina: AZLP issues opinion on processing of data abroad to Addiko Bank

The Agency for Personal Data Protection in Bosnia & Herzegovina ('AZLP') published, on 18 August 2017, an opinion to Addiko Bank A.D. Banjaluka with regard to the processing of personal data of foreign clients in Croatia following its outsourcing to Addiko Banka d.d. Zagreb.

The AZLP stated that Addiko Bank is required to regulate the relationship with Addiko Banka d.d. Zagreb, as the data processor, including the scope and the purpose of the same, as well as put in place adequate guarantees regarding technical and organisational measures for the protection of personal data. In addition, the AZLP held that being the country of destination, and as a member state of the EU, Croatia indisputably fulfils the requirement of country providing an adequate level of protection of personal data, as set out in Article 18 of the Law on the Protection of Personal Data (49/06).
