The State Council of the People's Republic of China released, on 27 September 2020, the Beijing Municipality Regulations on Public Health Emergencies. In particular, the regulation provides, among other things, protection for whistleblowers and personal information obtained during public health emergencies. Specifically, the regulation outlines that medical and health institutions, among others, must take protective measures against personal information obtained in response to public health emergencies to prevent leakage and misuse, noting that workers and individuals must not divulge or misuse personal information.

In addition, the regulation provides that workers and individuals have the right to report hidden dangers of public health emergencies to the Central People's Government and its relevant departments, highlighting that the same will ensure that the reporting channels are unblocked, and establish acceptance, investigation, and handling mechanisms. Moreover, the regulation outlines that a reporter's personal information and personal safety, as well as other legal rights and interests, will be protected in accordance with the law, and that reported hidden public health emergencies will be investigated and verified. Furthermore, the regulation maintains that the municipal and district health departments will reward reporters and will not be held accountable for non-malicious false reports.
