Australia: Bill prohibiting sharing of sexually explicit deepfakes passes Parliament

On August 21, 2024, the Attorney General (AG) announced that the Criminal Code Amendment (Deepfake Sexual Material) Bill 2024 was passed by the Parliament on the same date. The bill imposes criminal penalties on those who share sexually explicit material without consent, including material that is digitally created using artificial intelligence (AI) or other technology.

The offenses under the bill are subject to criminal penalties of up to six years imprisonment for sharing non-consensual deepfakes of sexually explicit material. Where the person also created the deepfake that is shared without consent, there is an aggravated offense that carries a higher penalty of seven years imprisonment.

Next steps

The bill will become law after receiving Royal Assent by the Governor-General.
