Algeria: Data protection law published in Official Gazette

Law No. 18-07 of 25 Ramadhan 1439 Corresponding to June 10, 2018 Relating to the Protection of Individuals in the Processing of Personal Data ('the Law') was published, on 10 June 2018, in the Official Gazette of the Democratic and Popular Algerian Republic.

In particular, the Law introduces the rights to information, access, rectification and opposition, as well as regulates direct marketing and other obligations of the data controller, including confidentiality and data security. Moreover, the Law regulates cross-border data transfers and includes enforcement provisions, with both administrative and criminal sanctions. In addition, it establishes an independent data protection authority within the President of the Republic of Algeria's office.

The Law provides that persons carrying out the processing of personal data must comply with the provisions of the Law by one year from the date of the establishment of the data protection authority.
