Argentina: AAIP finalizes establishment of AI transparency and personal data protection program

On September 4, 2023, Resolution No. 161/2023 of the Agency for Access to Public Information (AAIP) was published in the Official Gazette of the Argentine Republic, through which the Transparency and Personal Data Protection Program in the Use of Artificial Intelligence was created. Specifically, the AAIP stated that the program's purpose is to promote processes of analysis, regulation, and the strengthening of state capabilities necessary to support the development and utilization of artificial intelligence (AI), both in the public and private sectors, while ensuring the effective exercise of citizens' rights in matters of transparency and personal data protection.

The program encompasses research on regulatory advancements in Argentina, the implementation of AI systems, and practices for preventing risks and vulnerabilities. Moreover, the program promotes the institutionalization of the Multidisciplinary Advisory Council with experts in the field to encourage social participation and governance through consensus and agreements on sectoral policies.

Additionally, the program will fall under the purview of the National Directorate for Transparency Policy Evaluation and the National Directorate for Personal Data Protection. In this way, the AAIP noted that it aims to support the exponential growth of integrating AI into technological solutions in various fields. Furthermore, the program pays special attention to potential social, economic, cultural, and environmental risks that must be studied and addressed to prevent biases and discrimination that could widen inequalities.
