Bavaria: BayLfD issues guidelines on data protection requirements in procurement procedures

The Bavarian data protection authority ('BayLfD') issued, on 27 April 2023, guidelines on data protection as a criterion in procurement procedures. In particular, the guidelines outline procurement processes, identify which gateways open up in procurement processes for data protection requirements, and explain how these can be used in a targeted manner, taking into account the most recent rulings by procurement chambers and courts. More specifically, the guidelines clarify the intersections between data protection legislation and public procurement law, highlighting the applicable requirements for cloud services.
