Armenia: PDPA issues guidance on data processing for memory device repair service providers

The Agency for Personal Data Protection of the Ministry of Justice of the Republic Armenia ('PDPA') issued, on 26 September 2019, guidance on personal data processing for memory device maintenance and repair service providers ('the Guidance'). In particular, the Guidance notes that memory devices include hard disks, portable memory devices, computers, mobile phones, and USB flash drives. In addition, the Guidance highlights that equipment repair services almost never have policies on data protection, and as such, requires service providers to ensure that the equipment given to them and information held therein is not accessible to third parties, and does not view, duplicate, or interfere with the data on the device.

Furthermore, the Guidance states that service providers should take action to prevent devices containing personal data from accidental loss or destruction, and must issue customers with a notice about their duty to ensure privacy and confidentiality. Finally, the Guidance notes that if repair is impossible without access to the personal data in the device, the service provider should inform the customer and obtain his/her consent before repairing the device.
